By accessing or using MortgageDetail ("Service"), operated by MortgageDetail.com, LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
MortgageDetail is a software-as-a-service (SaaS) platform that enables mortgage professionals to create mortgage comparison presentations, including side-by-side loan comparisons, amortization visuals, and closing cost breakdowns. The Service is intended for use by licensed mortgage professionals and is not a substitute for professional mortgage advice.
To use the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for safeguarding your account credentials and for all activities that occur under your account. By registering, you represent and warrant that you hold a valid NMLS license and are authorized to originate or broker mortgage loans in your jurisdiction. Use of the Service by unlicensed individuals constitutes a material breach of these Terms.
The Service is offered on a subscription basis at the price listed on our pricing page. Subscriptions renew automatically each billing cycle unless cancelled. You may cancel your subscription at any time through your account settings.
A 3-day free trial is available for new accounts. No credit card is required to start the trial. At the end of the trial period, your account will automatically enter a read-only state — you will not be charged, and no automatic conversion to a paid subscription will occur. To continue using the Service after the trial, you must manually upgrade to a paid plan through your account settings. During the read-only period, your existing presentations and data will be preserved but you will not be able to create or edit presentations.
We reserve the right to change subscription pricing with 30 days' advance notice. Price changes will take effect at the start of your next billing cycle following the notice period.
You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to the Service through the end of your current billing period. No prorated refunds are provided for partial billing periods.
After your subscription ends, your account will enter a read-only state for 30 days, during which you may export your data. After the 30-day grace period, your presentation data and account content will be scheduled for permanent deletion. If you wish to export your data before deletion, contact us at support@mortgagedetail.com.

You retain ownership of all content you create or upload through the Service, including presentations, loan data, branding assets, and client information ("Your Content"). You grant us a limited license to host, store, and display Your Content solely to provide and operate the Service.
You are solely responsible for ensuring that Your Content and your use of the Service comply with all applicable federal, state, and local laws and regulations. The Service is a presentation tool only and does not validate, certify, or guarantee the regulatory compliance of any output. Without limitation, you acknowledge sole responsibility for compliance with:
MortgageDetail.com, LLC is not responsible for any regulatory violations, fines, or enforcement actions arising from your use of the Service or the content of presentations you create.
The Service tracks when and how often shared presentations are viewed by recipients and provides this information to you. By using the presentation sharing features, you agree to inform your clients and recipients that their viewing activity (including open timestamps and view frequency) is tracked and reported to you. Failure to provide such notice to recipients may violate applicable privacy and electronic communications laws.
Presentations, comparisons, scenarios, amortization schedules, closing-cost breakdowns, and any other outputs generated through the Service (collectively, "Presentations") are illustrative and informational only. You acknowledge and agree that Presentations:
You are solely responsible for ensuring that any Presentation you create, share, deliver, or transmit complies with all applicable advertising, marketing, disclosure, and substantive lending laws, including but not limited to TILA, RESPA, TRID, ECOA, the SAFE Act, the CFPB Mortgage Acts and Practices — Advertising Rule (Regulation N), and applicable state laws. You agree that you will not represent any Presentation to any borrower, applicant, or other recipient as a Loan Estimate, Closing Disclosure, binding offer, commitment, approval, or guaranty.
The Service is a software tool for licensed mortgage professionals and does not provide financial, legal, tax, investment, accounting, or regulatory-compliance advice. Nothing presented through, calculated by, or generated using the Service constitutes such advice. The Service is not a substitute for the independent judgment of a licensed mortgage professional, attorney, accountant, or other qualified advisor. Any reliance you or any third party places on Service output is solely at your own risk.
MortgageDetail.com, LLC is a software-as-a-service provider only. Nothing in these Terms or your use of the Service creates any fiduciary, agency, broker-client, advisor-client, partnership, joint venture, or employment relationship between you and us, between us and any recipient or borrower, or between us and any of your clients. We are not a mortgage broker, mortgage lender, mortgage servicer, real estate broker, financial institution, credit reporting agency, or insurance provider. We do not originate, underwrite, fund, broker, refer, recommend, approve, deny, price, or service any loan, and we do not endorse any particular lender, loan program, rate, or product offered or compared through the Service.
The Service may display market data sourced from third parties, including but not limited to U.S. Treasury yields (such as the 10-year Treasury), mortgage-backed securities pricing, index rates, and related financial benchmarks. This data is provided "as is" for informational purposes only, may be delayed (including by 15 minutes or more, as labeled in the Service), may be incomplete or inaccurate, and may be modified, discontinued, or replaced at any time without notice. We make no representation or warranty as to the accuracy, completeness, timeliness, or fitness for any purpose of any third-party data, and we shall have no liability for any loss arising from your or any recipient's reliance on such data. You are responsible for independently verifying any rate, index value, or other market data before using it in a Presentation or in any client-facing communication.
When you share a Presentation link with a recipient (including a borrower, applicant, referral partner, or any other third party), the recipient is not a customer or contractual counterparty of MortgageDetail.com, LLC by virtue of viewing that Presentation. Recipients access shared Presentations subject to the notices displayed on the viewer page, our Privacy Policy, and these Terms as applied to viewer access. Recipients may not rely on a Presentation as a Loan Estimate, Closing Disclosure, binding offer, commitment to lend, pre-approval, pre-qualification, or any guaranty of credit, rate, payment, or terms, and recipients should request formal, lender-issued disclosures and seek independent professional advice before making any financial decision. We are not responsible to any recipient for the accuracy, completeness, regulatory compliance, or substantive content of any Presentation, all of which is the sole responsibility of the user who created it.
You are solely responsible for obtaining all consents required by applicable law before using the Service to send, deliver, or share Presentation links or any other communication with any recipient by email, SMS, MMS, push notification, automated dialer, prerecorded message, or any other electronic means. Without limitation, you are solely responsible for compliance with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, the Telemarketing Sales Rule, the Florida Telephone Solicitation Act, and any analogous federal, state, or local law governing commercial electronic communications, including consent, opt-out, identification, and recordkeeping requirements. You agree to indemnify and hold us harmless from any claim, fine, penalty, or settlement arising from your use of the Service to send communications without the required consent or in violation of any such law.
From time to time, we may make features available on a beta, preview, alpha, evaluation, early-access, or other pre-release basis ("Beta Features"). Beta Features are provided "as is" and "as available" without warranty of any kind, may contain bugs or errors, may be discontinued or modified at any time without notice, and are subject to additional terms we may specify when making them available. Notwithstanding any other provision of these Terms, our liability for any Beta Feature is limited to the maximum extent permitted by law, and the warranty disclaimers and limitation of liability in these Terms apply with full force to Beta Features.
The Service, including its design, features, code, documentation, and branding, is owned by MortgageDetail.com, LLC and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or brand features without our prior written consent.
We respect the intellectual property rights of others. If you believe that content available through the Service infringes your copyright, you may submit a takedown notice in accordance with the Digital Millennium Copyright Act (DMCA) by providing the following information to our designated DMCA agent:
Send DMCA notices to legal@mortgagedetail.com. Upon receipt of a valid takedown notice, we will remove or disable access to the allegedly infringing material and notify the user who posted it. Users may submit a counter-notice if they believe the content was removed in error.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not guarantee the accuracy of any calculations, projections, or analyses generated by the Service. You are responsible for verifying all loan data and calculations before presenting them to clients.
To the maximum extent permitted by law, MortgageDetail.com, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
MortgageDetail.com, LLC shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to: acts of God, natural disasters, epidemics or pandemics, fire, flood, earthquake, war, terrorism, civil unrest, labor disputes, government actions or orders, internet or telecommunications infrastructure failures, third-party service disruptions (including but not limited to outages of our hosting, database, or payment processing providers), cyberattacks, power failures, or any other event that could not have been reasonably foreseen or prevented. During any such event, our obligations under these Terms will be suspended for the duration of the event.
You agree to indemnify and hold harmless MortgageDetail.com, LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any applicable law or regulation.
We may suspend or terminate your account at any time if you violate these Terms or for any other reason at our discretion, with or without notice. Upon termination, your right to use the Service will immediately cease. You may export Your Content before termination. Sections regarding intellectual property, disclaimers, limitation of liability, indemnification, and the arbitration clause survive termination.
You represent and warrant that you are not located in, under the control of, or a national or resident of any country to which the United States has embargoed goods or services, and that you are not listed on any U.S. government list of prohibited or restricted parties. You agree to comply with all applicable export control laws and regulations, including the Export Administration Regulations (EAR) and sanctions programs administered by the Office of Foreign Assets Control (OFAC).
Binding Arbitration.Any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute") shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The arbitration shall be conducted by a single arbitrator in the State of Florida. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
Class Action Waiver.You agree that any Dispute will be resolved on an individual basis only. You waive any right to participate in a class action, collective action, or representative proceeding, whether as a named plaintiff, class member, or otherwise. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class, collective, or representative proceeding.
Small Claims Exception.Notwithstanding the foregoing, either party may bring an individual action in small claims court for Disputes within the court's jurisdictional limits.
30-Day Opt-Out. You may opt out of this arbitration provision by sending written notice to legal@mortgagedetail.com within 30 days of first accepting these Terms. Your notice must include your name, account email address, and a clear statement that you wish to opt out of binding arbitration. If you opt out, Disputes will be resolved in the state or federal courts located in Florida.
We may update these Terms from time to time. We will notify you of material changes by posting the updated terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Subject to the arbitration provision above, any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Florida.
E-SIGN Consent. You consent to the use of electronic signatures and to the electronic delivery of these Terms, the Privacy Policy, account notices, billing statements, transaction confirmations, legal notices, and any other agreement or disclosure between you and us. You may withdraw your consent to electronic delivery by closing your account; in that case, you will no longer be able to use the Service. You are responsible for maintaining current contact information and the hardware and software needed to access electronic records (a current web browser, internet connection, and an active email address).
Entire Agreement. These Terms, together with the Privacy Policy and any order form or written agreement signed by both parties, constitute the entire agreement between you and us regarding the Service and supersede all prior or contemporaneous communications, proposals, and agreements (oral or written) on the same subject.
Severability. If any provision of these Terms is held invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, severed, and the remaining provisions shall continue in full force and effect.
No Waiver. Our failure or delay in enforcing any provision of these Terms shall not constitute a waiver of that provision or of any other provision. A waiver must be in writing and signed by an authorized representative of MortgageDetail.com, LLC to be effective.
Assignment. You may not assign or transfer these Terms or any rights or obligations hereunder, by operation of law or otherwise, without our prior written consent. Any attempted assignment in violation of this section is void. We may freely assign or transfer these Terms in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law. These Terms bind and benefit the parties and their permitted successors and assigns.
Notices. Notices to you may be delivered by email to the address associated with your account or by posting in the Service, and are effective when sent or posted. Notices to us must be sent to legal@mortgagedetail.com with a copy by U.S. mail to MortgageDetail.com, LLC, P.O. Box 2413, Nokomis, FL 34275, and are effective upon our receipt.
Independent Contractors; No Third-Party Beneficiaries. The parties are independent contractors. These Terms do not create any third-party beneficiary rights, and no recipient, borrower, or other person who is not a party to these Terms shall have any right to enforce them.
Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.
